No, Ontario does not require it, and a will you prepare yourself can be valid. A lawyer matters most when your estate or family is even a little complex, since small mistakes are expensive to fix after you are gone. Fixed fees keep the cost clear up front.
A government formula decides who inherits, and you lose all say in the matter. A married spouse receives a preferential share of the first $350,000, with the rest divided according to fixed rules. A common law partner does not automatically inherit anything, no matter how long you lived together.
A will only takes effect when you die. Powers of attorney cover what happens if you are alive but unable to make decisions. Without them, nobody gains authority automatically, not even your spouse or your adult children, and somebody would have to apply to the court to be appointed your guardian.
Court processing commonly takes a few weeks to a few months depending on the court location. Settling the whole estate usually takes closer to a year, once you account for collecting assets, paying debts and taxes, and obtaining a clearance certificate from the Canada Revenue Agency.
Review it after any major life change, such as a marriage, a separation, a birth, a death, or a significant change in your assets. In Ontario marriage no longer revokes a will, but separation can affect gifts left to a spouse, so it is worth a review either way.
